Several different groups were involved in the packaging and marketing of the Banyan Tree Program to potential participants. Some of these marketers used a favourable tax opinion letter from Fraser Milner Casgrain LLP, a prominent national law firm, to market the program. Now, many of these participants are banding together in a class action lawsuit to sue these actors and Fraser Milner Casgrain LLP for damages of over $50M. The damages are calculated to include the amounts paid in now missing security deposits, the disallowed tax credits and interest payable on the tax owing as a result of the reassessment. The class action suit is being handled by Hamilton law firm Scarfone Hawkins LLP, which has significant experience in handling class action claims.

Le nouveau projet de loi C-10 qui amende la section 125.4 de la Loi sur l’impôt sur le revenu soulève, avec raison, un tollé de réactions. L’indignation envers le projet de loi vise principalement le pouvoir discrétionnaire octroyé au Ministre du Patrimoine canadien de refuser ou de retirer l'agrément des crédits d’impôt à une production cinématographique lorsqu'il est d'avis que celle-ci ne respecte pas «l'ordre public».

On March 25th Dwight Duncan, the Ontario Minister of Finance, tabled the Ontario Liberal government’s 2008 Budget. The budget proposes to parallel some of the initiatives that were put forth in the federal budget. As a result, there are some new tax measures that will impact charities.
